These terms and conditions govern your use of our website, guides, programs and services; by using our website, you accept these terms and conditions in full.

1. ACCEPTANCE OF TERMS

By accessing the Site or using any Program, Course, Guide, Workshop, Coaching Container, Membership, or Functional Testing Option (“Services”), you agree to be bound by these Terms of Use (“Agreement”), the Privacy Policy, and the Medical & Testing Disclaimer.

IF YOU DO NOT AGREE, YOU MUST NOT USE THE SITE OR SERVICES.

2. ELIGIBILITY

To use the Site or Services, you represent and warrant that:

- You are 18 years old or older, OR the legal age of majority in your jurisdiction.

- You have the full legal capacity to enter into this Agreement.

- Your use is voluntary and lawful.

- You are responsible for ensuring your use complies with your local laws.

If you do not meet these requirements, do not access the Site or Services.

3. EDUCATIONAL-ONLY NATURE OF SERVICES

All content delivered by EndoNutrition (Khush Sra) is for general educational, informational, and lifestyle guidance purposes only.

We DO NOT:

- diagnose

- treat

- cure

- prevent any disease

- provide medical advice

- replace medical care

You agree to seek medical advice from your physician before altering medications, supplements, diet, or treatment plans.

NO doctor-patient, dietitian-patient, or clinician-patient relationship is created through use of our Services.

4. THIRD-PARTY FUNCTIONAL TESTING

If your Program includes functional testing (e.g., DUTCH®, GI-MAP, organic acids, nutrient, genetic testing):

- Testing is performed by independent third-party laboratories, not EndoNutrition/Khush Sra.

- Lab companies are solely responsible for all sample processing, data storage, privacy, accuracy, and reporting.

- You must review and accept each lab company’s Terms, Privacy Policy, and Data Handling Practices before submitting samples.

- We only receive test results you voluntarily provide.

- Our role is to provide educational interpretation, not medical interpretation.

We are NOT responsible for:

- lost samples

- shipping delays

- lab errors

- privacy breaches by labs

- changes to lab-company data policies

- delays in reporting

- inaccurate or incomplete test results

You assume full responsibility for engaging with third-party labs.

5. ACCOUNT SECURITY

If you create an account, you agree to:

- Keep your login information confidential.

- Not share access with anyone.

- Notify us immediately of unauthorized use.

We may revoke access for misuse, inappropriate conduct, or breach of these Terms.

6. PAYMENTS, BILLING & REFUNDS

Unless specified otherwise:

- ALL Program, Course, Digital Product, and Testing purchases are NON-REFUNDABLE.

- Payment plans must be completed in full, whether or not you use the Services.

- Subscriptions can be cancelled for future billing periods only (no retroactive refunds).

- Failed payments must be updated within 5 business days to maintain active access.

- Chargebacks result in immediate removal from all Services and forfeiture of future access.

You authorize the Company to charge the payment method on file for all agreed-upon fees.

7. NO GUARANTEES

While many clients experience meaningful improvements, the Company does not guarantee:

- symptom changes

- cycle changes

- fertility changes

- hormone shifts

- lab result changes

- medical outcomes

- personal or physiological results

Your outcomes depend on many factors beyond our control.

8. INTELLECTUAL PROPERTY

All content, including:

- frameworks

- methods

- scripts

- videos

- worksheets

- recordings

- guides

- templates

- assessments

- presentations

is owned by EndoNutrition / Khush Sra.

You are granted a personal, non-transferable, non-commercial license to use the materials.

You MAY NOT:

- copy

- reproduce

- teach

- resell

- license

- distribute

- repurpose

- print and share

- upload publicly

- create derivative works

Violation results in termination of access and legal remedies.

9. WINS, TESTIMONIALS & CLIENT STORY CONSENT

We regularly highlight anonymous client wins and case patterns for education and marketing.

9.1 Default: Anonymous or Initials Only

Unless you request otherwise, we may use your:

- written statements

- insights

- progress updates

- wins

- non-identifiable health patterns

in anonymous or initials-only form.

9.2 Identifiable Use With Consent

We will only use identifiable information with explicit verbal or written consent, including:

- verbal agreement to the organizer during a recorded call

- clicking “Accept” on Zoom when the session is recorded

- submitting a testimonial, feedback form, or progress form

- written permission via email, chat, or message

- voluntarily providing a testimonial

9.3 What We Never Share Without Consent

We request written consent for:

- identifiable lab reports or diagnostic details

- identifiable audio or video recordings

9.4 Educational Case Use

We may refer to case patterns (e.g., “a client with lupus had high estrogen on her DUTCH panel”) without identifying you.

9.5 Adjusting Your Preferences

You may request anonymity for any future use (not retroactive).

10. GROUP CALLS, RECORDINGS & PARTICIPANT BEHAVIOR

Group coaching calls, Q&As, and workshops may be recorded.

By attending, you acknowledge:

- your voice/video/chat may be visible

- you may turn off camera/mic anytime

- recordings may be used for educational access

- we cannot control participants’ behavior (e.g., screenshots, saving chats)

You are responsible for your participation comfort level.

11. USER-GENERATED CONTENT

If you post or upload content in any community space or communication feature, you grant us a license to use, display and reproduce it for educational or community purposes.

You may not post:

- harmful or abusive content

- medical misinformation

- advertisements

- illegal content

- offensive or threatening material

We may remove content or revoke access at our discretion.

12. COMMUNICATION SERVICES

The Site may offer community features including:

- forums

- chat spaces

- comment areas

- private groups

- live call chats

You agree not to:

- harass, threaten, or harm others

- share others’ private information

- impersonate individuals

- upload malware or harmful files

- spam or solicit clients

- disrupt community or impact the integrity of the business

We have no obligation to monitor communications but may remove content or restrict access at any time.

13. TEMPLATES, FORMS, & DOWNLOADABLES

If you download resources (free or paid):

- You receive a single-user license only.

- You may NOT resell, redistribute, modify, or use them commercially.

Violation may result in legal action.

14. GUEST EXPERTS & THIRD-PARTY CONTENT

When guest speakers or external experts appear in Programs:

- we do not verify the accuracy of their statements

- their views do not necessarily reflect ours

- we are not responsible for their content or actions

Guests transfer rights to any recordings or content to the Company.

15. THIRD-PARTY LINKS

We are not responsible for third-party websites, labs, or services linked from the Site.

Use them at your own risk.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company is not liable for:

- injuries

- health outcomes

- supplement reactions

- medical events

- lab errors

- data breaches by labs

- participant behavior

- reliance on educational content

- delays or disruptions

- inability to access the Site

- loss of data

You assume all risks associated with using the Services.

17. INDEMNIFICATION

You agree to indemnify and hold harmless the Company, its staff, and contractors from any claim or expense arising out of:

- misuse of the Site or Services

- violation of this Agreement

- decisions made based on educational content

18. ARBITRATION AGREEMENT

ALL disputes arising from the Site or Services must be resolved exclusively through binding arbitration in Ontario, Canada, using a mutually agreed-upon arbitrator.

You waive:

- court

- jury trial

- class action rights

Each party covers its own legal costs unless law requires otherwise.

19. SEVERABILITY

If any part is invalid, the rest remains enforceable.

20. GOVERNING LAW

This Agreement is governed by the laws of the Province of Ontario.

Arbitration is the exclusive dispute resolution method.

21. MEDICAL & TESTING DISCLAIMER

The Services are educational only and do NOT replace medical care.

We do not diagnose, treat, cure, or prevent disease.

Functional test interpretation is educational only.

Seek immediate medical care for urgent concerns.

22. PRIVACY POLICY

We collect only the information necessary to deliver Services, including:

- contact information

- purchase history

- program activity

- optional functional testing data

- feedback and wins

We DO NOT sell personal data.

We only share data with essential service providers (email platforms, payment processors, labs you choose to test with).

You may access, correct, or request deletion of your data within legal limits.

We use standard security measures but cannot guarantee complete online security.
